Terms and Conditions

Hamilton Movers is a trading name of Auckland Movers & Storage 2024 Ltd  |  GST No. 143-638-294

By booking a move with Hamilton Movers, you agree to the following terms and conditions. Please read them carefully before confirming your booking.

1. Bookings, Pricing & Cancellations

  • Pricing: Quotes are estimates. Minimum job duration is 2 hours. Charges are calculated on actual working hours from arrival at the first property to complete unloading at the destination, rounded up to the next 30-minute increment.
  • Deposits & Cancellations: 72 hours' notice is required to cancel or reschedule without penalty. Cancellations within 72 hours forfeit the deposit and incur a minimum 1-hour labour charge plus the call-out fee.
  • Delays & Force Majeure: We are not liable for delays or failures to perform caused by circumstances beyond our reasonable control (e.g., extreme weather, traffic, natural disasters). Final charges may vary if the job takes longer due to such delays.

2. Customer Responsibilities & Access

  • Preparation & Packing: Disclose all items at booking. Items must be packed, accessible, and appliances disconnected prior to arrival. We accept no liability for damage to items improperly packed by the customer, or for any scratches, dents, or marks to furniture that the customer has not adequately wrapped or protected for transit.
  • Access & Third-Party Property: Customer must ensure adequate parking and access, bearing any parking fines. You are responsible for ensuring we are authorised to access shared driveways, building common areas, or neighbouring land. Liability for unavoidable damage to third-party property while following your instructions rests with you.
  • Heavy & High-Value Items: Items over 60kg (e.g., pianos, double-door fridges, marble, spa pools) incur a $95 fee for a required third mover. High-value items (antiques, art, jewellery) must be declared at booking, otherwise they are moved entirely at Owner's Risk regardless of value.
  • Prohibited Items: We will not transport hazardous materials, explosives, or illegal substances. Potted plants are transported entirely at the customer's risk.

3. Risk, Liability & Property Damage

  • Goods in Transit (Owner's Risk): Under the Contract and Commercial Law Act 2017, all removals are carried out at Owner's Risk. We accept no liability for loss or damage to goods unless caused by our negligence. We strongly recommend arranging transit insurance (which we can facilitate through Aon Insurance).
  • Property Scuffs: While we use protective equipment and reasonable care, minor scuffs to walls, door frames, stairwells, and floors are an inherent risk of moving heavy furniture. We are not liable for cosmetic marks that are an unavoidable incident of the service.
  • Driveways & Underground Services: Damage to driveways, lawns, footpaths, or underground pipes caused by our heavy vehicles is un-insurable. If instructed to drive or park in such areas, compliance is solely at the customer's risk, and we accept no liability for subsequent damage.

4. Claims, Storage & Payment

  • Claims & Photos: Damage claims must be lodged in writing to [email protected] within 7 calendar days of the move. We hold no liability for pre-existing damage. We reserve the right to photograph goods and property for condition records. Damage claims are investigated concurrently with your outstanding invoice.
  • Temporary Storage: If goods cannot be delivered on the agreed date (e.g., keys unavailable), we may hold them in temporary storage at your cost and at Owner's Risk for up to 30 days.
  • Payment: Due in full upon job completion via EFTPOS or Credit Card (3% surcharge applies). No cash. Commercial customers may be invoiced subject to prior written agreement.
  • Defaults: Invoices unpaid after 7 days accrue 15% interest per annum, calculated daily. The customer is liable for all debt collection agency fees and legal costs.

5. Eco Bin & Crate Hire (If Applicable)

  • Hire Period & Cancellations: Bins are delivered approx. 7 days prior to moving and collected 7 days after. Bin cancellations within 48 hours of delivery incur a $45 fee. Extensions are $4.00/week per bin.
  • Condition & Fees: Customer assumes all risk of loss or damage. Bins must be returned clean and dry. A $5 cleaning fee applies per soiled bin. A $35 replacement fee applies for lost/cracked bins.

6. General Legal & Safety

  • Safety Hazards: We reserve the right to refuse service for undisclosed health, safety, or environmental hazards. If service must be refused on-site due to an undisclosed hazard, reasonable charges for time and travel incurred up to that point will still apply.
  • Consumer Rights & Privacy: Nothing in these terms limits your statutory rights under the Consumer Guarantees Act 1993. Personal data is handled in accordance with the Privacy Act 2020.
  • Disputes: Must be raised directly within 14 days. Unresolved disputes may be referred to the Disputes Tribunal of New Zealand.
